NEW ORDER ON CUSTOMS CLEARANCE OF SPECIFIC PRODUCTS

Law of Ukraine No. 2829-VI "On Amendments to the Law of Ukraine 'On the Ukrainian Customs Tariff'" dated 21 December 2010 took effect and introduced a new version of the Ukrainian Classification of Products of Foreign Economic Activity.

Pursuant to the above Law, on 24 February 2011, the Kyiv Regional Customs Office of Ukraine issued Order No. 196 "On Introducing Temporary Technological Scheme for Customs Clearance of "Cover-Up" Products Moved across the Customer Border of Ukraine" (hereinafter – Order No. 196). According to Order No. 196, the "cover-up" products are those that may be declared, with a high degree of probability, as products of the "risk group".

Order No. 196 establishes that "cover-up" products shall be subject to mandatory classification procedures stipulated by said Temporary Technological Scheme for Customs Clearance of "Cover-Up" Products Moved across the Customer Border of Ukraine. Also, in the course of customs control and customs clearance of such products customs inspection must be carried out and a respective statement of the customs inspection must be executed.

According to the State Customs Service Ordinance No. 16/2-r dated 31 January 2011, all previous resolutions concerning classification of products and assignment of codes to them according to the Ukrainian Classification of Products of Foreign Economic Activity are considered to be void.

Order No. 196 is being widely criticized by experts and busnisses. Most experts believe that Order No. 196 is only aimed at replenishment of the State budget.
