After the outstanding success of The Lawyer European Awards 2010, The Lawyer once again turns its attention to recognizing the achievements of law firms based on the Continent.

This year the awards travel to Geneva where, on 28th September, Europe’s finest lawyers will once again gather to celebrate the most outstanding work in the industry over the previous 12 months.

The CIS Leading Counsel Network, a professional network of nine leading law firms across the Commonwealth of Independent States (former Soviet Union), was shortlisted for the European Law Firm Network of the Year Award, along with well-established and reputed international legal networks, such as Ius Laboris, Lex Mundi, MSI Global Alliance, World Law Group.

The CIS LCN member for Russia, Egorov Puginsky Afanasiev & Partners, was also shortlisted for The Lawyer European Award as Law Firm of the Year: Russia and The CIS.

The entry process is straightforward and uses a standard entry form with set fields to ensure consistent entries and a fair playing field for all firms.

Whittled down from hundreds of entries, the shortlist features firms from across Europe. Quality and innovation rather than size is the key to inclusion.

A panel of judges, including well travelled managing partners at private practice firms and in-house counsel at multinational companies, once again aids the selection process.

RULG contributes pro-bono services to the The Glory of Ukraine exhibition of spiritual and national treasures opened on February 11, 2011 at the Joslyn Art Museum in Omaha, Nebraska. Dr. Irina Paliashvili participates in the opening of the exhibition and speaks at the Doing Business in Ukraine Luncheon and Workshop organized by the U.S.-Ukraine Business Council (USUBC) in conjunction with the exhibition.

Одна из самых передовых площадок для общения представителей регионального юридического бизнеса вызывает неизменный интерес и у западных юристов. Об особенностях события этого года мы поговорили с одним из идеологов Форума Ириной Палиашвили.

Hands across the CIS
The CIS would seem to provide the perfect opportunity for Russian and Ukrainian firms to open offices across the region. James Swift examines why has creating a lasting pan-CIS firm proved such a challenge.

"At first glance Russian firms would seem like the more ideal candidates for CIS expansion, if for no other reason than because Moscow is a more mature jurisdiction and, logically, a better one from which to base a CIS empire. But unlike any city in Ukraine, Moscow experienced a free-for-all of international firms coming in to stake their claim, taking advantage of the country's lack of regulation. The entire magic circle is in Moscow, as is the cream of the US. For many domestic firms, scratching a living in Russia is a big enough task without the distraction of expansion.

"The local Russian firms have had to fight to get to the upper echelons [of the market] because this is taken by international firms and so maybe they were so focused on getting through and becoming full service that they didnýt have the extra focus, resources or time to do this," says Irina Paliashvili, president and senior counsel at the RULG-Ukrainian Legal Group. "Their priority was to become fully competitive in their own market."

Survey on Ukraine's legal market, which reflects its background and current state and talks about issues important for the future development.

"A new generation of Ukrainian lawyers is freeing itself from the established legal houses, highlighting the ambitions and limitations of the market."

For Irina Paliashvili, president and senior counsel at RULG these developments are indicative of a growing generation gap between the country's legal pioneers and a new breed ...: "The next generation of lawyers has worked in international firms or studied abroad and there are dozens of newly-formed firms because it is so easy to start one up. Graduates can simply get a website, call themselves partners and create a law firm very cheaply compared to established firms."

The Survey also discusses how the crisis has affected the legal market in Ukraine.

"And for the market's more senior lawyers, the crisis has actually brought some much-needed normality to the market. "It was the boom times that were abnormal, when firms were dictating to and neglecting clients, and young lawyers didn't want to get out of bed for just anyone," says RULG's Irina Paliashvili.

- отмечает г-жа Палиашвили.

Создание в 2009 году CIS Leading Counsel Network (LCN), профессионального объединения юридических фирм государств экономического региона СНГ стало новацией на постсоветском пространстве. ... Юридические фирмы Армении, Азербайджана, Беларуси, Киргизстана, Молдовы, России, Туркменистана и Украины объединились в LCN с целью предоставления интегрированных консультативных услуг в странах СНГ. Представители этих фирм встретились в Киеве и провели виртуальный юридический экскурс. ...

В ходе встречи участники проанализировали как экономическое положение государств, так и состояние их законодательства. Как отметила Ирина Палиашвили, президент RULG, регион СНГ характеризуется тем, что все его участники вышли из одного государства и в них есть как много схожего так и много отличий. Сравнительный анализ региона дал возможность понять какие особенности ведения бизнеса свойственны странам СНГ и сделать соответствующие выводы.

Интересно то, что в ходе встречи инвестиционный режим в Украине и её законодательную базу назвали либеральной анархией. Упрёки звучали в сторону законодательной базы, как существующей, так и разрабатываемой и практики государственных органов, которая противоречит требованием законодательства. Более того, ни одни нормы в Украине жестко не соблюдаются.

По словам Ирины Палиашвили, как только бизнес сталкивался с государственным аппаратом, судебной системой, какими-либо спорами, которые попадают в суды, у него начинались проблемы, так как обнаруживалось, что бизнес пошёл далеко вперёд, работая на практическом уровне. В ходе встречи представители Украины отметили, что в отличие от России, где были применены антикризисные меры, в Украине соответствующий антикризисный закон относительно инвестиционного климата, который был принят в прошлом году, на самом деле повернул государство на 10 лет назад. Это ухудшило репутацию Украины на международной арене и усложнило ведение бизнеса, что шокировало инвесторов. "То есть, к сожалению, пока что практика и бизнес в нашем государстве намного прогрессивнее, чем законодатели и государство", - заметила г-жа Палиашвили.

На VI Ежегодном форуме юридических фирм, проводимом АЮУ (Ассоциацией юристов Украины) 26 февраля 2010 г. в Киеве обсуждались последствия финансового и наступившего вслед за ним экономического кризиса для юридического бизнеса в Украине

Ирина Палиашвили (RULG - Ukrainian Legal Group): "На украинском рынке всегда доминировали национальные фирмы, и эта тенденция только усиливается. Мне кажется, что из - за кризиса конкурентная борьба, во первых, приобрела здоровый и полезный характер, то есть теперь мы боремся за клиента (а не за привлечение молодых юристов в свои фирмы) и, соответственно, улучшаем качество и ценность наших услуг для клиента; во-вторых, она обострилась не только между национальными и иностранными (транснациональными) юридическими фирмами, а между всеми игроками. В то же время украинские клиенты вышли на новый этап развития - их интересует цивилизованный глобальный бизнес, поэтому они стали интересны для юристов и юристы стали интересны для них. На VI Форуме юридических фирм под названием "Развитие рынка юридических услуг в Украине-2010", проводимом Ассоциацией юристов Украины, среди других обсуждался вопрос оценивания партнёров партнёрами юридической фирмы.

"Собственно, соотносящийся с этой проблемой риторический вопрос поставила перед аудиторией Ирина Палиашвили, президент Украинской юридической группы: поскольку в большинстве юридических фирм фактически путь к партнёрству закрыт - как должна происходить смена поколений партнёров? Революционно - кто-то уходит, кто-то приходит, ушедшие создают собственные фирмы, пришедшие - новые порядки, или эволюционно? И что тогда делать с теми, кто был партнёром с самого начала?"

Washington, D.C. - On Wednesday, February 10th in Kyiv, Ukraine and on Thursday, February 18, 2010, in Washington, D.C., press conferences and meetings were held to launch the report by the Independent International Experts Commission on how to reform Ukraine's economy after its presidential election.

The Commission calls for profound structural changes in 2010, including [1] full-fledged inflation targeting; [2] gas sector reform; [3] realistic energy pricing; [4] a comprehensive deregulation of enterprise; and the [5] conclusion of an Association Agreement, including a deep and comprehensive free trade agreement, with the European Union.

The Commission is co-chaired by Anders Äslund and Ukrainian Professor Olexander Paskhaver. PIIE Director C. Fred Bergsten is also a member of the Commission.

В прошлом году стало известно о создании профессиональной сети CIS Leading Counsel Network, участниками которой, в частности, стали Aequitas (со стороны РК) и Ukrainian Legal Group (cо стороны Украины). Ирина Палиашвили, президент Ukrainian Legal Group, признается, что ее фирме рынок Казахстана интересен. Сейчас есть совместные проекты, однако пока они исходят от украинской компании. "Но мы уверены, что будут генерироваться и проекты из Казахстана, и более широкие проекты через CIS Leading Counsel Network, которые будут включать и Казахстан, и Украину", - говорит г-жа Палиашвили.

Dr. Irina Paliashvili, President of RULG-Ukrainian Legal Group Law Firm, was one of the US-Ukraine Business Council members who shared on VOA their ideas as to what they expect from newly elected Ukrainian authorities:

"We expect stability and transparency, we expect clear rules for investment improvements, and being a lawyer I also have to say that everyone expects fundamental and radical improvements of the legal framework that would lift major barriers to investments, the latter requiring supremacy of law and modern regulation, which aspects are still non-existent in Ukraine".

US-Ukraine Business Council held its first investors training session on how to make use of OPIC services.

OPIC - a U.S. Government Agency that grants loans and provides insurance coverage for U.S. investments overseas - has resumed its operations in Ukraine. OPIC loans may range from 15,000 USD for small-scale businesses to 300 - 400 million USD on large investment projects.

Ms. Irina Paliashvili, President of RULG-Ukrainian Legal Group, said: "I think many of those investors who were disappointed by recent developments now have new expectations. This is not just moral support; they can contact OPIC to receive funds that are extremely difficult to find these days. I believe, therefore, these are excellent opportunities for both reputation and business development".

Yurydychna Gazeta, a newspaper which is widely read and respected within Ukraine's professional legal community, has announced the launch of a unique project -- an Expert Council. The Expert Council is an association of Ukrainian lawyers, People's Deputies and other public officers who will share their professional opinions in various spheres in newspaper articles.
